1. Agreeing to these terms

By using polyswing.co you agree to these terms. If you don't agree with them, please don't use the site. In these terms, “we” and “us” mean PolySwing, the operator of this website.

2. You must be 18 or over

This site concerns adult relationships and is intended solely for adults. By using it or joining the waiting list, you confirm you are at least 18 years old and that it's lawful for you to view this material where you live. If you're under 18, leave.

3. What this site actually is

polyswing.co is a marketing site for an application that is in development and not yet available. This matters, so we'll be blunt about it:

• Features described anywhere on this site — including verification, boundary enforcement, moderation response times, messaging, events, and travel — describe what we intend to build. They are not currently available and are not guarantees.
• The design preview at polyswing.co/prototype is a clickable mockup. Nothing in it is functional software, the people and events in it are invented, and its contents will change.
• We may change direction, change features, delay indefinitely, or decide not to launch at all. Joining the waiting list gives you no right to the product and no claim if it never ships.

4. Comparisons with other services

Some pages compare PolySwing's intended features with other platforms, and quote complaints published about them. Those comparisons reflect publicly available information on the date shown on the page, and other companies change their products and pricing without telling us. Verify anything you intend to rely on. All third-party names and marks belong to their respective owners, and their use here is descriptive — it doesn't imply any affiliation or endorsement.

5. The waiting list

Joining is free and creates no contract between us beyond these terms. You agree to submit an email address you actually control. We may remove any address from the list at our discretion — for instance, if it's obviously fake or being used to abuse the form — and you may remove yourself at any time by emailing us. How we handle your address is described in our Privacy Policy.

6. Acceptable use

You agree not to:

• use the site for anything unlawful, or in breach of any law that applies to you;
• submit other people's email addresses without their permission, or automate, scrape, or flood the sign-up form;
• attempt to gain unauthorised access to the site, its database, or its infrastructure, or to probe or test its defences;
• interfere with the site's operation or availability, or introduce malicious code;
• copy substantial parts of the site to pass off as your own, or use our name or branding in a way that suggests we're affiliated with or endorse you.

7. Our content

The text, design, layout, graphics, and code of this site belong to us or our licensors and are protected by copyright. You may read, link to, and share the site freely, and quote reasonable extracts with attribution. You may not reproduce it wholesale or use it commercially without permission.

8. Links to other sites

Where we link to other websites — including sources cited in our research — we do so for reference. We don't control them, we're not responsible for their content or their privacy practices, and a link isn't an endorsement.

9. No professional advice

Nothing on this site is legal, medical, psychological, or relationship advice. Content about safety, consent, or sexual health is general information only. Decisions about your relationships and your health are yours, ideally with people qualified to advise on them.

10. The site is provided as it is

We provide this site “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't promise the site will be uninterrupted, error-free, or that any information on it is complete or current.

11. Limitation of liability

To the fullest extent permitted by law, we won't be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of this site — and our total liability for any claim relating to the site or the waiting list is limited to one hundred US dollars (US$100).

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, or for death or personal injury caused by negligence. Some jurisdictions don't allow certain exclusions, so parts of this section may not apply to you.

12. Indemnity

You agree to indemnify us against claims, losses, and reasonable costs arising from your breach of these terms or your misuse of the site.

13. Changes to these terms

We may update these terms. The date at the top shows when they last changed, and continuing to use the site after a change means you accept the updated version. If we make a change that materially affects people on the waiting list, we'll email them.

14. Ending access

We may suspend or withdraw access to the site, in whole or in part, at any time and without notice. You can stop using it whenever you like.

15. Governing law

These terms are governed by the laws of the State of [STATE TO BE COMPLETED], United States, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located there, and you and we each consent to that jurisdiction. If you're a consumer resident elsewhere, this doesn't deprive you of any protection under the mandatory law of your own country.

16. Everything else

If any provision of these terms is held unenforceable, the rest stays in force. Our failure to enforce a provision isn't a waiver of it. These terms, together with the Privacy Policy, are the entire agreement between us about this site.
